По каким причинам не выпускают за границу?

При наличии задолженностей по кредитным выплатам, алиментам или штрафам у человека могут возникнуть серьезные проблемы, в том числе с пересечением границы. При каких условиях нельзя покинуть пределы своего государства?

Причины, по которым вы не можете покинуть свою страну

Один из факторов — выезд с несовершеннолетним лицом за границу без доверенности родителей. Более того, один из родителей может подать заявление в полицию для запрета выезда с его ребенком. Такая ситуация часто возникает при расторжении брака, когда супруги находятся в плохих отношениях.

Запрет касается и работы на должностях, которые связаны с хранением государственной тайны (к ней относятся важные экономические и политические сведения, военная информация, данные о науке).

До получения судебного решения по уголовному делу подозреваемые и обвиняемые не могут покинуть Россию. Тем не менее, долги – наиболее распространенный вариант.

Однако основная причина – наличие задолженности перед частным лицом, кредитными организациями или государством. Именно ее следует рассмотреть подробнее.

Условия, при которых вам могут запретить выезд.

Процесс закрытия выезда за границу происходит в несколько этапов.

Шаг 1. Наличие судебного решения

Вынесено решение суда, по которому с физического лица или индивидуального предпринимателя взыскиваются какие-либо выплаты, решение дополняется исполнительным листом, по которому задолженность взыскивается судебными приставами в принудительном порядке.

Это может быть невыплаченный кредит банку или МФО, просроченные алименты и штрафы от ГИБДД, коммунальные платежи. Если вы просрочили свои обязательные выплаты, но при этом

Наверное, почти каждый взрослый человек в нашей стране слышал о том, что при выезде за границу у должников по кредитам, налогам, алиментам или штрафам могут возникнуть проблемы вплоть до отказа в выпуске за рубеж.

Попробуем разобраться, в каких случаях и при какой сумме долга действительно могут не выпустить за границу. Все данные, приведенные в этой статье, основаны на действующем законодательстве РФ.

Гражданин РФ может быть временно ограничен в выезде за пределы страны только при соблюдении определенных условий.

При каких условиях не выпускают за границу

Сразу следует оговорить, что рассматривается ситуация, когда у человека есть долги. Есть и иные основания для временного ограничения в передвижении, например, допуск к совершенно секретным сведениям. Такие причины в данной статье не рассматриваются.

Чтобы у пограничников было право отказать вам в пересечении границы, должны быть соблюдены одновременно все перечисленные условия:

1. Есть решение суда.

Должно быть решение суда о том, что с гражданина или индивидуального предпринимателя взыскивается определенная задолженность, а также должен быть выдан исполнительный лист на принудительное взыскание (через службу судебных приставов).

Правовое основание — ч. 5 ст. 15 Федерального закона от 15.08.1996 N 114-ФЗ «О порядке выезда из Российской Федерации и въезда в Российскую Федерацию».

При этом не играет роли характер денежных средств: с одинаковым успехом это может быть неоплаченный кредит, штрафы ГИБДД, алименты, коммунальные долги и так далее. По любой из таких задолженностей может быть принято решение суда о ее взыскании.

Поэтому, если вы просрочили выплату по кредиту, не оплачивали три месяца плату за коммунальные услуги или долго не платили алименты, но в суд никто не обращался и ничего с вас не взыскивал, то можно спать спокойно и собирать чемодан в отпуск. И совершенно точно можно не читать следующие пункты.

2. Вы уклоняетесь от оплаты суммы долга, указанной в решении суда и исполнительном листе, выданном судом.

Проще говоря, решение суда есть, но вы по нему не платите без уважительных причин. Уклонившимся от уплаты вы будете считаться с того момента, когда истек срок для добровольной оплаты долга. Стандартный срок для добровольной оплаты — 5 дней со дня получения должником постановления о возбуждении исполнительного производства.

Правовое основание — ч. 5 ст. 15 Федерального закона от 15.08.1996 N 114-ФЗ «О порядке выезда из Российской Федерации и въезда в Российскую Федерацию» и ч. 12 ст. 30 Федерального закона от 02.10.2007 N 229-ФЗ «Об исполнительном производстве»

До тех пор, пока задолженность не будет оплачена, у судебного пристава есть право ограничить Ваш выезд из России. Об этом — в следующем пункте.

3. Судебным приставом вынесено постановление о временном ограничении на выезд должника из РФ.

Пристав может это сделать по собственной инициативе либо по просьбе взыскателя, то есть того лица, которому Вы должны.

Для вынесения такого документа личное пристутствие должника не требуется, но пристав обязан направить ему копию постановления не позднее дня, следующего за днем его вынесения (подписания). Таким образом, должник теоретически должен быть уведомлен о факте появления такого документа, который закроет ему выезд за границу.

Но на практике может оказаться, что Вы не получали никаких постановлений и узнаете о его наличии только в аэропорту.

Правовое основание — ч.1 и 10 ст. 67 Федерального закона от 02.10.2007 N 229-ФЗ «Об исполнительном производстве».

Три перечисленных условия в комплексе — безусловное основание для того, чтобы гражданину было отказано в выезде из России. Не существует смягчающих обстоятельств и уважительных причин, которые позволили бы пограничникам закрыть на это глаза.

Даже если вы оплатите прямо в аэропорту свой долг через интернет — банк или другие сервисы, снять запрет так быстро приставы не смогут.

Процедура отмены запрета на выезд из страны может занимать до двух недель с момента оплаты долга. Выход один — проверять информацию о своих долгах и оплачивать их заранее, ну или отдыхать на российских курортах.

8 основных причин, по которым могут не выпустить из страны

1. Задолженности по оплате штрафов ГИБДД, налогов, алиментов, коммунальных услуг, кредитов.

2. Уклонение от исполнения обязательств, наложенных судом. Запрет действует до тех пор, пока обязательства не будут выполнены, или пока не будет достигнуто согласие сторонами дела.

3. Для несовершеннолетнего ребенка: если один из родителей (или законных представителей) не согласен выпускать ребенка из страны. Для того чтобы вывезти ребенка за рубеж,  потребуется нотариально заверенное согласие на выезд. (ФЗ «О порядке выезда из РФ и въезда в РФ»)

4. Допуск к гостайне. Срок, в течение которого человек, допущенный к гостайне, не должен выезжать за границу, указывается в соответствующем договоре о допуске к гостайне.

5. Призыв на военную службу или направление на альтернативную службу. Выезжать из страны будет нельзя до окончания военной или альтернативной гражданской службы.

6. Задержание по подозрению в преступлении или привлечение к уголовному делу в качестве обвиняемого. Запрет на выезд длится до тех пор, пока не будет вынесено решение по делу или не вступит в силу законный приговор суда. Также запрещено выезжать тем, у кого имеется непогашенная судимость.

7. Сообщение заведомо ложных сведений о себе при оформлении документов на выезд из страны. В таком случае вопрос с документами решается соответствующим органом, оформляющим подобные  документы.

8. Просроченный паспорт. Также для въезда в некоторые страны требуется, чтобы загранпаспорт был действителен в течение определенного промежутка времени после въезда в страну.

Согласно действующему законодательству, на оплату штрафа дается 60 дней (ст. 32.2 КоАП), после чего информация о неплательщике передается в Федеральную службу судебных приставов (ФССП). В отношении человека, не заплатившего вовремя штраф, открывается исполнительное производство, могут быть применены меры воздействия – вплоть до ареста машины и запрета на выезд за границу. О том, что вы задолжали государству, и выезд был запрещен, вы можете узнать прямо в аэропорту или на границе – чтобы избежать этого, лучше до поездки проверить нет ли вашего имени в списках должников. После того как вы оплатили штраф, вам придется предоставить подтверждение оплаты нужной суммы в тот орган, который вынес постановление о наложении штрафа. Как узнать, есть ли за вами задолженность?

— Узнать о наличии задолженностей можно, обратившись в Службу судебных приставов. Другой вариант — «пробить» по базе данных ФИО человека на сайте ФССП.

Можно также заказать соответствующую госуслугу, которая предоставляется бесплатно:

 — Проверить, есть ли за вами неоплаченный штраф ГИБДД, можно также на портале Госуслуг.

— На сайте ФНС

можно по своему ИНН (индивидуальному номеру налогоплательщика) узнать о задолженности по уплате налогов;

— Чтобы проверить задолженность банкам по кредитам, рекомендуется воспользоваться системой интернет-банкинга, с помощью которого можно погасить неоплаченную сумму. Или же просто позвонить в представительство банка, выдавшего кредит, или прийти в банк с удостоверением личности.

— Узнать о неоплаченных услугах ЖКХ можно в ЖЭУ (Жилищно-эксплуатационной конторе). Кроме того, можно воспользоваться электронной базой данных. К примеру, можно зайти на сайт Банка Москвы, раздел «Квартплата» и там ввести код налогоплательщика и указать период оплаты.

 

В кабмине разъяснили порядок выезда россиян за границу — Общество

МОСКВА, 8 июня. /ТАСС/. Россияне, которым разрешается выезд в другие страны, нужно будет предъявлять документы, подтверждающие цель поездки. Как говорится в распоряжении правительства РФ, опубликованном на сайте кабинета министров, нужны будут подтверждающие документы для поездок на лечение, на работу и учебу, для ухода за больными родственниками.

С 30 марта правительство из-за пандемии коронавируса временно ограничивало движение через автомобильные, железнодорожные, пешеходные, речные и смешанные пункты пропуска через государственную границу Российской Федерации, а также через сухопутный участок российско-белорусской государственной границы. Новым документом, подписанным премьер-министром РФ Михаилом Мишустиным 6 июня, вносятся изменения в этот порядок. Запрет на выезд россиян за границу не будет действовать в нескольких случаях, которые нужно будет подтверждать документально.

Так, гражданам РФ, выезжающим из страны на лечение, надлежит предъявить «документы (копии документов) принимающей медицинской организации, подтверждающих лечение, с указанием времени проведения лечения или документы (копии документов), оформленные Минздравом России». Россиянам, однократно выезжающим из Российской Федерации к нуждающимся в уходе больным близким родственникам (супругам, родителям, детям, усыновителям, усыновленным), опекунам и попечителям, нужно предъявить «документы (копии документов), выданных медицинской организацией, подтверждающих их состояние, а также копии документа, подтверждающего степень родства». Также члены семьи (супруги, родители, дети, усыновители, усыновленные), опекуны и попечители лиц, в том числе иностранных граждан, проживающих за пределами Российской Федерации, должны иметь «действительные документы, удостоверяющие их личность, копии документов, подтверждающих степень родства и право члена семьи на проживание в иностранном государстве либо наличие у него гражданства иностранного государства, для однократного выезда из Российской Федерации к месту проживания членов семьи». 

Кроме того, россиянам, однократно выезжающим из страны в связи с осуществлением трудовой деятельности на территории иностранного государства, следует иметь «документы, подтверждающих факт осуществления трудовой деятельности (трудового договора (контракта) с иностранным работодателем или его копии, разрешение на работу, выданное уполномоченной организацией принимающей стороны, а также разрешение на право въезда в иностранное государство в указанных целях)». 

В распоряжении тем, кто однократно выезжает за пределы РФ для получения образования в иностранных образовательных организациях, предписывается иметь «документы (копии документов), подтверждающие получение образования в конкретной иностранной образовательной организации, или документы (копии документов) российской образовательной организации о направлении обучающихся на обучение в иностранной образовательной организации, а также разрешение на право въезда в иностранное государство в указанных целях». 

Ранее в понедельник Мишустин объявил о введении таких правил.

Об иностранцах, въезжающих в РФ

В распоряжении также уточняется, что въезд для лиц, которые прибывают в РФ с целью лечения, будет осуществляться «при условии предъявления действительных документов, удостоверяющих их личность и признаваемых РФ в этом качестве, и визы, либо в безвизовом порядке в случаях, предусмотренных международными договорами РФ, а также документов или копий документов, выданных медицинской организацией, подтверждающих приглашение на лечение, с указанием времени проведения лечения или документов, оформленных Минздравом России».

Что касается лиц, однократно въезжающих в страну к нуждающимся в уходе больным близким родственникам (супругам, родителям, детям, усыновителям, усыновленным), опекунам и попечителям, то им, помимо документов, удостоверяющих личность и визы, если наличие таковой обусловлено международными договорами, придется предъявить документы, подтверждающие степень родства, а также документы, выданные медицинской организацией, которые подтвердят состояние родственников. 

Как уточнил Михаил Мишустин на заседании президиума Координационного совета по борьбе с распространением новой коронавирусной инфекции 8 июня, решение внести изменения в действующий режим ограничений на въезд и выезд было принято по итогам рассмотрения поступивших в правительство обращений граждан.

Ограничение и запрет на выезд за границу из России из-за коронавируса с 30 марта с дополнениями от 29 апреля и 8 июня

В конце марта были введены 2 указа: о запрете на международные полеты и закрытие сухопутных и водных границ России. Выехать за границу для обычных граждан и туристов не предоставляется возможным.

С 6 июня 2020 года из России разрешается выезжать тем, кто едет на учебу, работу, лечение или уход за близкими родственниками. Премьер-министр страны Михаил Мишустин подписал указ от 6 июня № 1511-р, он опубликован на сайте правительства России.

Таким образом, поехать в европейские страны из России можно лицам, которые имеют национальную визу категории D, которая позволяет учиться и работать в странах ЕС.

8 июня 2020 года премьер-министр России дополнил категории граждан РФ, кому разрешен выезд за границу:

  1. Для учебы в зарубежных странах.
  2. Для работы.
  3. Для лечения.
  4. Для ухода за близкими родственниками.
29 апреля 2020 года указ о запрете был продлен запрет на въезд иностранцев в Россию на неопределенный срок премьер-министром страны М. Мишустиным.

C 8 июня 2020 года иностранцам разрешили въезжать в Россию:

  • для лечения в российских учреждениях,
  • для ухода за родственниками.

Запрет на международные воздушные перелеты из России с 27 марта 2020 года

Россия с 23 марта ввела ограничение на международные полеты.

Россия с 30 марта закрыла все сухопутные, морские и речные границы

С 30 марта были закрыты морские, речные, железнодорожные границы Российской Федерации. Распоряжение от 27 марта за N 763-р опубликовано на официальном сайте правительства России.

Введен запрет, официально ограничение, на въезд и выезд из страны.

Сделали исключение для следущющих категорий граждан.

  1. Граждане России могут возвращаться на родину из-за рубежных стран.
  2. Обычные граждане России могут покинуть пределы страны: для работы, учебы, лечения, ухода за близкими родственниками.
  3. В Россию можно приезжать для лечения в медицинских учреждениях и для ухода за родственниками.
  4. Водители международных грузовых компаний, сотрудники поездной бригады и работники речных судов, идущих за границу.
  5. Жители Калининградской области, следующие транзитом через иностранные государства к себе домой или в центральную часть России. В паспорте должна быть официальная регистрация о проживании в Калининградской области.
  6. Могут поехать к себе домой жители ЛНР и ДНР, у которых есть российский паспорт.
  7. Сотрудники дипломатических служб и члены их семей.
  8. По указу премьер-министра от 29 апреля 2020 года сейчас разрешается выезд из России для следования в места проживания лицам, имеющим ВНЖ, гражданство или иной документ, удостоверяющий право на постоянное проживание в другом государстве.

Спикер совета Федераций Валентина Матвиенко и премьер Михаил Мишустин посоветовала российским туристам не покупать билеты и турпутевки в иностранные страны до 2021 года. Давая понять, что границы могут быть закрыты для обычных граждан и туристических поездок в некоторые страны на целый год.

Карантин на 14 дней для российских граждан, прилетевших из-за границы

Для всех граждан России, которые возвращаются в страну из любой заграничной поездки с 18 марта 2020 года введен обязательный 14-дневный карантин.

Запрет въезда в страны Шенгенской зоны и Евросоюза с 17 марта

Европейские государства приняли решение и закрыли границы для граждан всех других стран, которые не входят в состав Шенгенской зоны и Евросоюза на 30 дней. Есть ли запрет на въезд в Турцию

С 14 марта 2020 года Турция закрыла въезд в страну из многих европейских стран. Для россиян правила въезда в Турцию остаются прежними, но международные рейсы не летают.

Отменены международные сообщения и авиарейсы. Попасть в Турцию просто так для граждан России не предоставляется возможным.

С 12 июня власти Турции открыли границы и разрешили въезд для граждан России и жителей других государств на отдых. Пляжные курорты для туристов открыты.

Запрет въезда на Украину с 16 марта 2020 года из-за коронавируса

С 16 марта 2020 года введен запрет въезда на Украину на 2 недели для россиян, белорусов, казахстанцев и любых других иностранцев из-за эпидемии короновируса COVID-19 сообщается на официальном сайте МИДа Украины на украинском языке.

Закрыли въезд в страну для всех иностранцев, за исключением тех, кто имеет ВНЖ или ПМЖ Украины. Украинцы могут без ограничений возвращаться к себе в страну. С 17 марта 2020 года страна закрывает пассажирское авиасообщение.

В самой стране введен режим Чрезвычайного Положения.

Запрет на въезд в ОАЭ из-за короновируса с 19 марта 2020 года

С 19 марта введен полный запрет на въезд в ОАЭ для россиян и всех других иностранцев сообщает сайт ria.ru.

Исключение составляют те, у кого есть действующие резидентские визы (аналог ВНЖ), которые позволяют жить и работать в стране. У них будет проводиться тест на наличие короновируса в аэропорту по прилету.

С 17 марта 2020 года ОАЭ перестала выдавать любые визы для иностранных туристов.

Таким образом, ОАЭ  закрыла полностью свои границы из-за эпидемии короновируса с 19 марта 2020 для граждан России.

С этого числа разрешен только вывоз туристов из страны в свои государства. Те, кто уже прилетели в ОАЭ, могут там находится до своего рейса обратно.

Запрет въезда во Вьетнам с 18 марта 2020 года из-за коронавируса

С 18 марта действует запрет на въезд во Вьетнам для россиян, украинцев, белорусов и иностранцев. Все прибывающие будут помещены на карантин на 14 дней сообщает сайт interfax.ru.

С 15 марта страна также прекратила выдавать любые визы для туристов.

Фактически, Вьетнам закрыл границы для всех иностранных граждан, прибывающих из США, всех стран Европы и Юго-Восточной Азии.

Запрет на въезд в Италию

Запрет на въезд в Индию на Гоа и другие штаты

Официально объявила о запрете въезда россиян и всех других иностранных туристов с 13 марта по 31 мая 2020 года Индия. Регулярно продлевает карантин и ограничения на передвижение в стране.

Действие всех туристических и других виз на этот период времени прекращено сообщает сайт tass.ru. Электронные визы в Индию во время карантина не действуют, по ним попасть в страну нельзя.

С 13 марта вступает в силу ограничение на полеты в Испанию, Францию и Германию. Исключения делаются лишь для некоторых прямых рейсов в крупные города: Париж, Мюнхен, Берлин, Франкфурт-на-Майне, Мадрид, Барселону. Об этом официально сообщено на официальном сайте правительства России.

Ограничение международного авиасообщения в России с 23 марта 2020 года

С 23 марта вводится временное ограничение на международные перевозки из России в зарубежные страны.

С 23 марта  в виде исключения разрешены авиаперелеты в зарубежные страны только из Москвы. Полный список разрешенных направлений международных рейсов можно прочитать на официальном сайте Росавиации.

Международные рейсы осуществляются только из Москвы в столицы и крупные города зарубежных стран, которые не закрыли международное авиасообщение.

Ограничения въезда в США для жителей Европы

США с 13 марта 2020 года на 30 дней запрещает въезд на территорию страны гражданам европейских стран, входящих в Шенгенскую зону сообщает сайт interfax.ru .

Гражданам России въезд в Соединенные Штаты Америки официально разрешен, но запрещено въезжать в страну любым иностранцам, которые в течение 14 последних дней были в 26 странах Шенгенской зоны.



Таким образом полететь в США с пересадкой в Европе из России не получится. Полететь из России в США можно только в Нью-Йорк.

Запрет въезда в Россию для иностранцев с 18 марта 2020 года из-за коронавируса

Россия ввела ограничение и запрет въезда для всех иностранцев и лиц без гражданства на свою территорию с 18 марта по 1 мая 2020 года из-за чрезвычайной ситуации и риска распространения короновируса COVID-19. Продление ограничения въезда после 1 мая

После 1 мая 2020 года границы не открыли, ограничения продлили на неопределенный срок. С 8 июня 2020 года разрешили въезд в РФ для лечения и ухода за близкими родственниками.

Россия закрыла все границы для туристов. Ограничения въезда касаются также всех граждан Беларуси и иностранцев, проезжающих через границу России и Беларуси.

Исключение составляют иностранные лица:

  • приезжающие на лечение в российских медицинских учреждениях и для ухода за близкими родственниками,
  • имеющие официальное право постоянно проживать на территории РФ,
  • водители грузовых международных автомобилей,
  • транзитные пассажиры, которые летят через аэропорты в другую страну,
  • лица, которые едут на похороны,
  • экипажи самолетов и кораблей, поездные международные бригады,
  • сотрудники дипломатических и консульских учреждений,
  • с 30 апреля въезжать могут иностранные рабочие для наладки иностранного оборудования на предприятиях.
  • с 8 июня для лечения и ухода за пожилыми родственниками.

Премьер-министр сказал, что закрытие границ и запрет въезда в РФ носит временный характер и связано с рекомендациями ВОЗ в связи с острой ситуацией из-за распространения короновируса COVID-19.
